Kevin Heaney was declared bankrupt at the court in Truro this morning. In the meantime, Truro City Football Club is reported to have been sold to the Chairman of Salisbury City Football Club. Which, if true, is illegal. A strange coincidence that Truro City and Salisbury City play each other this weekend.

How is it that the wheels of justice grind so very, very slowly?

This man has been worming his way through Cornwall for over a decade. There have been so many warnings about him, and hundreds, thousands, know him to be a con-man and a fraudster. He's spread misery everywhere he's crawled, and yet it takes both his bankruptcy, and the sale of the football ground that was held in trust for Truro and Cornwall, to spark an unequivocal reaction in the media.

How is it that Covenanted land has been heavily mortgaged, the loans called in and now sold at all? How could loans have been raised legally against covenanted land where there was no discussion and agreement, and where no suitable alternative site existed? There are undoubtedly those who were further involved in this, whether intentionally or otherwise, as part of the con. There's no shame in being used to front something where you have no real idea what's being done - but there would be shame in keeping quiet any longer than is necessary now.

You are right that Heaney's a Fraud, and he needs to be totally exposed as such and brought to account. This scandal has gone on for far too long already. It may not be too late to save the football ground if his early actions in taking control of it are uncovered in time. Certainly the proposals that Salisbury be involved are flawed, because Heaney is connected, and there are conflicts of interest; and based on past patterns of activity, it's equally possible that he's linked to 'JoJo Investco Ltd' at one or two removes in acquiring the ground and Club recently at knock-down rate.

This worm may temporarily have gone underground, but rest assured that for the time-being he's only tunnelling - unless he's stopped, he will re-emerge.

I dont understand how someone who has been declared bankrupt was listed as one of the richest people in the country just a few years ago. I dont know the details here but all I can see is the football ground being developed for more houses for Truro with more traffic and traffic lights and more delay on Highertown.

This will earn someone millions.

Someone like Heaney won't have gone into that bankruptcy court without a Plan B.

You're abs. right, Karma.

The West Briton published two lengthy rants of mine, in 2004 & 2005, warning what might well happen with Heaney & TCFC; but people were too busy then, making money, and aiding & abetting developers rape Truro, Falmouth & other small but character Cornish market towns. It took a global economic melt-down to bring crooks like Heaney to his knees, whilst slowing down other larger developers with dubious business practices (I recall two Persimmon Homes managers being jailed following crown court appearances in Plymouth, for various serious financial irregularities).

In terms of covenant land, TCFC land won't be the first bit of land sold to developers under false ownership rights, in Truro. Just look at the sale of Tregolls Farm to Wa** Homes, in the late '90s... That land was left by covenant to the people of Truro, nearly 100 years ago, by a wealthy local benefactor, as greenfield land, for the enjoyment of Truro families, and for generations to come. 

Step in prince Charles/Duchy of Cornwall, ECCI and Wa** Homes, and suddenly, in just 10 short years, it turns into one of the biggest, ugliest, flimsiest - yet highly profitable - and as always in Truro these days, unaffordable development (to local families who need it). The salt in the wound being that not only is it no longer green & pleasant recreational land for Truronians, but the new housing is generally not for Truronians either...

And given the state of the construction sector (marked up to -3.9%, yes minus, for Q2 2012), the name of the game, going forward, will be "build, build, build, anywhere, anyhow and at any cost", and bugger everything else. We're in a recession, God damn it! (and before you go blaming the PIIGS and/or Eurozone for anything, I'd look a little closer to home). And so expect the development onslaught on Truro & other Cornish market towns to pick up, as infrastructure, agricultural land, architecture, ethnicity, traffic, noise & light pollution issues, water & flooding, logic & common sense, all take a back seat to make way for government targets, bonuses, back-handers, mutual back-slapping, royal millions, growing business rates & council tax revenues, etc....

What I don't understand is why neither the Football Club's Trustees, nor Truro City Council/Cornwall Council/MP's, appear to be involving themselves directly in this debacle - unless some of them are involved 'behind the scenes' - because surely it all should be quite straightforward to unpick.

There is a Covenant.
It may have been altered - if so, on whose authority, when, by whom, why.
The Ground appears to have been mortgaged and re-mortgaged, possibly in excess of its true value.
Who lent the money, and what was their understanding of the documentation that was provided.
To whom did they lend, and ostensibly for what purposes - and what happened to this money.
Was it 'invested' in the Club, or elsewhere.
Is what has happened legal and above board, or is there evidence of wrongdoing.
Are the claims of the Lenders, Tiger Commercial, and other creditors, against the Ground/Club legitimate.
What is the status of the original Covenant, and what actions are open to Trustees/Councils/Supporters/Other Agencies and Authorities now.

Yes, you're right that Heaney will have a Plan B. He'll also have Plans C - Z in the drawer.
There are clear patterns in the way that he's operated for years. It's like a jigsaw puzzle, and he likes to keep the pieces apart, but if everyone co-operated here and brought their piece to the table, the picture would be very clear.

Involved 'behind the scenes'... Now there's an interesting and rather polite way of putting things, Karma!

Ellis, Greenslade, Mike Varney, Wallis, Wood, Mann, Fitter, Flashman, Pugh, Stoneman, Glenton-Brown, Chris Pascoe, to name but a few. There's just some of whose bank accounts I would love to examine, just to see whether Wa** Homes money may have inadvertently been (mis)placed - in the form of cash, of course... I don't just want to point the finger at Wain; could be Persimmon, Barratt, Cornish, Rosemullion, etc, etc....

You ask some excellent questions, there, Karma, though I doubt we'll ever get an answer to many of them. Too many vested interests, back-handers, shady deals will keep the whole affair obscured, for a long, long time; probably long enough that people stop caring... Call me cynical....

Many, many people are 'cynical' about Cllr Mike Varney, the 'Member Champion for Planning' and Chairman of the Strategic Planning Committee - who apparently lives in a Wain Home.

Not 'quite possibly'; most definitely. It's a running joke in Falmouth, that penniless Londoner mike Varney upgraded to a detached executive Wa** Home, shortly after his council U-turn on Wa** Homes planning application for developing Swan's Reach. The guy's at the top of the council's red list of most corrupt (non-)local politicians. He's a fraud on a huge scale going back years. Serves his (new) community? Perhaps occasionally, so long as the community doesn't get in the way of his own grand plans.

The fact is that over the expenses scandal more Labour MP's were prosecuted than Tory. Jaqui Smith claimed £116,000.00 for home allowance for living in a room in her sister's house so how she escaped being prosecuted is a mystery.

That's the problem with many Tories; they're not too clever. At the time there were many more Labour MPs than Tory MPs, so you'd expect there to be more on stats alone. This present government is the most incompetent you could imagine; it's almost unbelievable. Everything they've done has resulted in a worse situation than that achieved by the previous lot.
